1. Scope

The general terms and conditions (GTC) apply to all our business relationships and purchases in the online shop www.magnets-4-you.eu between us, magnets4you e.U., Kirchfeldgasse 30, 2102 Klein-Engersdorf, Austria and our customers. The version valid at the time of conclusion of the contract shall apply. Further provider information can be found under: Imprint.

The customer is a consumer insofar as the purpose of the ordered deliveries and services cannot be predominantly attributed to their commercial or independent professional activity. An entrepreneur, on the other hand, is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity.

2. Conclusion of Contract

As part of the ordering process, since we primarily deal in personalized goods, the necessary settings (image upload etc.) can first be made. After that, the desired goods can be placed in the shopping cart, the desired quantity changed, or selected goods edited. Customer data can then be entered and the shipping and payment method selected. Finally, an overview page is provided where the details can be checked, and input errors corrected or edited. If the ordering process is to be abandoned, the browser window can be closed.

The representations of goods in the online shop do not constitute a legally binding offer, but an invitation to order. By clicking the button [e.g. "Order with obligation to pay"] in the last step of the ordering process, a binding offer to purchase the goods shown in the order summary is made.

Immediately after submitting the order, an order confirmation is sent, which lists the customer's order again and which the customer can print by pressing the "Print" function button. However, this does not yet constitute acceptance of the contractual offer, but merely serves as proof of the successful receipt of the order. A contract with the customer is concluded as soon as the order is accepted by a separate email (order confirmation), or the goods have been dispatched.

If no copies of the product selected by the customer are available at the time of the order, the customer will be informed immediately. If the product is permanently unavailable, magnets4you will refrain from making a declaration of acceptance. A contract is not concluded in this case. If the product specified by the customer in the order is only temporarily unavailable, magnets4you will also inform the customer of this.

3. Prices and Shipping Costs

The prices do not include VAT, as we are exempt from VAT under the small business regulation pursuant to § 6 para. 1 no. 27 of the Austrian Value Added Tax Act (UStG).

The applicable shipping costs are shown in the web shop or will be communicated to the customer at the latest during the ordering process and are to be borne by the customer.

In the event of a withdrawal, the customer shall bear the direct costs of the return shipment.

4. Payment Terms

The customer is informed about the available payment methods on www.magnets-4-you.eu. In addition, the payment methods are displayed to the customer during the ordering process.

The purchase price is due immediately upon conclusion of the contract. Payment for the goods is made via one of the payment methods offered during the ordering process.

5. Retention of Title

Until full payment has been made, the sold goods remain the property of magnets4you e.U.

6. Delivery

Delivery times are calculated from the time of order confirmation, provided prior payment of the purchase price has been made. Unless no or a different delivery time is specified for the respective goods, it is 14 days.

Magnets4you e.U. currently only delivers to customers who have a delivery address within Germany or Austria.

7. Promotional Vouchers

Promotional vouchers issued free of charge as part of our promotions (e.g. voucher codes) can only be redeemed in the online shop and only during the specified promotional period. Individual goods may be excluded from the promotion. This follows from the content of the voucher promotion.

Voucher codes can be entered before completing the ordering process and will be deducted from the purchase total. Subsequent offsetting is not possible.

Only one voucher code can be redeemed per order. The value of the goods must be at least equal to the amount of the promotional voucher.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal when concluding a distance selling contract, about which they are informed in accordance with the statutory model. For personalized goods, meaning goods specified by the customer and manufactured exclusively for that purpose, the right of withdrawal is excluded.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us, magnets4you e.U., Kirchfeldgasse 30, 2102 Klein-Engersdorf, office@magnets-4-you.eu, by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not exist or expires prematurely for the following contracts for goods: contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

9. Warranty

The statutory warranty rights apply.

10. Data Protection

Magnets4you e.U. complies with the applicable data protection regulations, in particular the Data Protection Act (DSG) and the General Data Protection Regulation (GDPR). Specific information on how customer data is processed can be found during registration and in the privacy policy.

11. Applicable Law and Jurisdiction

Austrian substantive law shall apply to this contract, excluding the UN Convention on Contracts for the International Sale of Goods. However, pursuant to Art. 6 para. 2 Rome I Regulation, this choice of law does not deprive the contractual partner who is a consumer of the protection of the mandatory provisions of the law of the country of their habitual residence; these continue to apply.

12. Alternative Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions

Should any provisions of this contract be legally invalid, ineffective and/or void, or become so during their term, this shall not affect the legal validity and effectiveness of the remaining provisions.
